Final Notice and Public Explanation of a Proposed Activity in the 100-year Floodplain

To: All Interested Agencies, Groups and Individuals

This is to give notice of the Mobile County Commission (MCC) proposed activity within a 100-year Floodplain and wetlands. MCC has conducted an evaluation as required by Executive Orders 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 to determine the potential affect that its activity in the floodplain will have on the environment. Georgia Ave West is currently a private dirt road, approximately 1,000 feet long, extending west from Heron Bay Loop Road East. It serves approximately 8 households and is proposed for acceptance of maintenance by Mobile County in accordance with HB 281, Act No. 2019-307. Project may include clearing and grubbing the right of way; grading, adding base material and paving the roadbed; shoulder construction; drainage improvements, grassing; right of way and/or easement acquisitions; and other incidental work necessary for the completion of the project. The road will be added to the county’s inventory to be included for future (non-grant funded) regular maintenance.

MCC has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural beneficial values: (1) Continued maintenance as a private dirt road and (2) All construction activities must conform to the local floodplain and building requirements.

MCC has reevaluated the alternatives to building in the floodplain and has determined that is has no practicable alternative.  Environmental files that document compliance with Steps 3 through 6 of Executive Order 11988, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains and/or wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.   Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and/or wetlands, it must inform those who may be put at greater or continued risk.

TO BE ENTITLED

AN ACT

Relating to Mobile County; to provide further for the sheriff’s compensation by an annual expense allowance to expire at the end of the current term of office; to add an amount equal to the temporary expense allowance to the sheriff’s annual salary commencing with the next term of office.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) The Sheriff of Mobile County shall receive an expense allowance of thirty-three thousand dollars ($33,000) per year, payable in equal monthly installments from the general fund of the county. This expense allowance shall be in addition to all other compensation or benefits granted to the sheriff and may be treated as compensation for retirement benefits.

(b) Effective beginning the next term of office, the annual salary of the Sheriff of Mobile County shall be increased by thirty-three thousand dollars ($33,000) and the expense allowance provided for in subsection (a) shall become void.

(c) The Sheriff of Mobile County shall receive the same compensation increases as apply to all county employees.

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.

Home Inspection Services

The Mobile County Commission is soliciting the professional services of a qualified home inspector (individuals or firms) to perform housing inspections of single and multi-family properties. Home inspectors must be licensed through the Alabama Department of Finance Division of Construction Management (per Alabama Administrative Code Chapter 355-17-1).  Further, the home inspector must be familiar with HUD Housing Quality Standards (HQS) and requirements under the Uniform Physical Condition Standards (UPCS).  This service will be paid by funds provided by the U.S. Department of Housing and Urban Development and/or other funds as may require these services.

LAKE PURDY DAM IMPROVEMENTS PROJECT

Birmingham Water Works (BWW), in Birmingham Alabama is seeking a qualified construction subcontractor for installation of a comprehensive grout curtain as part of the proposed Lake Purdy Dam Improvement Project, hereinafter called the “Project”.  The BWW is anticipated to issue Bids for the Project in October 2023. The site location is Lake Purdy Dam, Lake Purdy Dam Road, Birmingham, AL.

We hereby, invite prospective grout subcontractors for the Project (project reference number P.01034) to complete an application for special pre-approval in order to be listed as a pre-approved subcontractor for the grout curtain portion of the work in the Contract Documents.

Birmingham Water Works will receive applications for the pre-approval until May 31, 2023 and complete the pre-approval process by June 2023.

The grout curtain portion of the project covered by this pre-approval is generally described as follows:

Construction of a multi-row grout curtain is to be installed along the project baseline from the spillway, non-overflow sections, and abutments of the dam. The program will consist of over 20,000 linear feet of rock drilling and coring and will primarily use a combination of medium mobility grout (MMG) and high mobility grout (HMG) in conjunction with both descending and ascending stage methods.  The intent of the program is to fill larger fractures and voids with the downstream row initial lower order holes by using HMG or MMG, while the downstream row higher order holes and upstream row grout holes will use HMG to grout the finer fractures.  Depending on foundation conditions, low-mobility grout (LMG) may be required on a case-by-case basis.  Several initial holes will be deemed “exploratory” and will be cored through the dam and foundation.  The grout subcontractor shall take necessary precautions to protect active drill holes and subcontractor equipment as a significant amount of the Work is located within an active spillway.

Construction of an RCC buttress on the downstream face of the existing stone gravity dam consisting of over 11,000 cubic yards along the existing masonry spillway. This work includes proportioning, mixing, transporting, placing, compacting and curing of the RCC.  RCC for this job is a mixture of aggregate and cementitious material blended with water to a damp consistency which permits hauling and spreading with earth moving equipment, and compaction with a vibratory roller with very little segregation of the aggregate. The RCC buttress will include cast-in-place concrete facing which will be formed and constructed in conjunction with each RCC lift.  The project may involve the provision of an onsite RCC batch plant for mixing of the product.

Brief Description:

The Piney Point Phosphogypsum Stack System (the “Stack System”) is in Manatee County, Florida. The Stack System has four partially closed phosphogypsum compartments. Phosphogypsum is a byproduct of fertilizer production. On August 25, 2021, the Manatee Circuit Court entered an order appointing Herbert R. Donica as a Receiver to take control of the Stack System and oversee its final closure. The Receivership is to remove the pond water inventory, maintain, repair, and permanently close the Stack System so it is no longer a threat to public safety and the environment. This procurement is for the Removal & Consolidation of Marine Sediments from the NGS-S Compartment, one of four phosphogypsum stack compartments, the New Gyp Stack – South (the “NGS-S”). The NGS-S has an area of about 72 acres (measured at the crest) and holds about 713,000 cubic yards of marine sediments. In addition, currently the compartment contains approximately 133,000,000 gallons of standing water (a mixture of accumulated rainfall, seawater, and remnant of pretreated process water). The NGS-S compartment was partially closed (i.e., lined with HDPE geomembrane) and used to store water and carryover marine sediments generated by the dredge operations, and does not have phosphate industry related process water (water quality data of all compartments will be provided with the bid documents).

The Removal & Consolidation of Marine Sediments in the NGS-S Compartment will involve three main components:

Component A – Dredging Operations:

(i) Contractor is to provide adequate equipment, labor, supervision, and operation plan to perform the dredge operations to meet the project’s objectives, restrictions, and schedule.

(ii) Unless nearby electric power is available, the Contractor is to provide independent power sources for the operation.

(iii) Operation Plan: The bid proposal shall include detailed operation plan to address all required elements in the Bid Invitation and Instructions including instrumentations such as online measurement with data logs of the percent solids of the dredged slurry streams. Instruments must be regularly calibrated to meet the manufacturer’s standards. Data loggers must be calibrated by the approved third party.

(iv) Any damage to the existing 80-mil HDPE geomembrane (Liner) by dredging operations can result in the shutdown of the dredge operations and costly liner repair. Therefore, it’s very important for the Contractor to submit a liner protection plan with its proposal to outline countermeasures (engineering control & operational) on the dredge operations to prevent causing damage to the 80-mil HDPE liner. If any damage occurs, it must be immediately reported to the Receiver.

(v) Operation plan should outline control measures and instruments to maximize the acquisition of the marine sediments, protecting the liner, and maintain the required percent solids in the slurry streams.

Component B – Geotextile Tube Operations:

  1. Base foundation of the dewatering bag operations: Foundation of the dewatering bag operations at two designated locations will be constructed by others.
  2. Geotextile tubes: To be provided by the Receiver unless the dredge Contractor is to bid and be awarded the work (see Bid Form).

iii. Provide and install pipes/hoses/connectors, valves etc. and operate/manage the geotextile tube operations including manifold system and polymer injection system.

  1. Provide equipment & skilled labor to monitor, maintain and maximize the effectiveness of the geotextile tubes operations including filling cycles, timely deactivation, and re-activation of feeding ports to maximize use of geotextile tubes, timely application of vibratory compactors to promote dewatering.
  2. Monitor and plan for filling cycles of the geotextile tubes and installation of new geotextile tubes for maintaining continuous dredge operations.
  3. If the dredge Contractor is responsible for providing the geotextile tubes, all Bid Instructions in the Geotextile Tube section of the bid documents shall apply.

Component C – Polymer Injection Operations:

  1. Provide, install, and operate the polymer injection system (polymer tanks, agitators, metering system, etc.) at the injection rates as directed by the Receiver. If the dredge Contractor is to provide the polymer, the Contractor is responsible for proper dozing of the polymer to meet project performance objectives and committed duration.
  2. The polymer injection system must be equipped with instrumentation to allow for continuous monitoring and keeping records of injection rate.

iii. The Receiver will monitor and test the performance of the polymer and dewatering process including consolidation rates in the geotextile tubes.

  1. If the dredge Contractor is responsible for providing the polymer, all Instructions in the Polymer section will apply.

The Contractor’s scope of work shall also include any other related tasks deemed necessary by the bidder except for the tasks to be performed by others described in the bid documents.

The Contractor shall also perform ancillary work activities which shall include but shall not be limited to receiving geotextile tubes, receiving/unloading polymer, tracking inventories of geotextile tubes and polymers.

Other Contractors (i.e., Polymer suppliers, geotextile tube manufacturers) are invited to participate in this bidding process as the suppliers. At any time after the Bid Invitation is issued, the Contractors (Dredge, polymer, and geotextile tube) can contact the Receiver (or his Site Manager) to schedule a suitable date and time for visiting the site and collecting samples of the marine sediments for testing.

[NOTE: The description of work to be performed set forth above is a general description of the three components of the project and is provided only to illustrate the general nature of the project. In the case of any discrepancy between the descriptions herein and the Bid Package, the provisions of the Bid Package shall control.]

The sealed proposal as described above shall be received by Mr. Carl E. Tyler, Superintendent, The Baldwin County Board of Education; 2600-A North Hand Avenue, Bay Minette, Alabama 36507, Phone: (251) 937-0306 until 2:00 PM Central Time, Thursday, May 11, 2023, then opened and read aloud.

A Mandatory Pre-Bid Conference will be held on Thursday, May 4, 2023,  at 10:00 AM  Central Time at the school.

All General Contractors bidding on this project shall be required to visit the site and examine all existing conditions prior to submitting their proposal. All Bidders shall have general liability and workman’s compensation insurance.

The project shall be bid excluding taxes. Bids must be submitted on proposal forms furnished by the Architect or copies thereof. No bid may be withdrawn after scheduled closing for receipt of bids for a period of ninety (90) days. The Owner reserves the right to reject any or all proposals and to waive technical errors if, in the Owners judgment, the best interests of the Owner will thereby be promoted.

A certified check or Bid Bond payable to Baldwin County Public Schools in an amount not less than five percent (5%) of the amount of the bid, but in no event more than $10,000.00 must accompany the bidder’s sealed proposal. Performance and statutory labor and material payment bonds will be required at the signing of the Contract.

All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Architect. All bidders shall show such evidence by clearly displaying current license number on the outside of sealed envelope in which the proposal is delivered.

Also, if you are not receiving NOTIFICATIONS from us, please register on our website, “Project Bid List” by selecting manage your bid list profile. The documents may be viewed on-line and printed by General Contractors, Sub‑Contractors and Suppliers. Documents published through this procedure are the only documents endorsed by the Architect. The Architect is unable to monitor, confirm and maintain other websites that provide documents. Addendums will be provided to entities that have CONFIRMED bidding for this particular project. The Architect retains ownership and copyrights of the documents. If bidders require printed sets, please submit request to the Architect at mckeeplans@gmail.com. Include your first & last name, company name, address, phone number and the project name and number. Print sets are to be returned in reusable condition within ten days after bid opening.

All RFIs and RFAs regarding the bid documents shall be sent and addressed through emails found on the RFI and RFA forms in the project manual.  NOTE:  ONLY THE RFI AND RFA FORMS IN THE PROJECT MANUAL WILL BE ACCEPTED.   The Architect will not accept inquiries via telephone or fax.

ADVERTISMENT FOR BIDS

Sealed bids will be received by the City of Semmes at Semmes City Hall (One Main Street, Semmes, AL 36575) until 2pm on Thursday May 11, 2023, and thereafter the same will be publicly opened for furnishing all labor and materials, and performing all Work required by the City of Semmes for the following Project:

BID DOCUMENT NO: 2023-02

SEMMES COMMUNITY CENTER ADDITION

45 calendar days will be allowed for the completion of the Project.

The work will consist of the following: Addition of a 20’x40’ metal building to the existing Semmes Community Center metal building located at 10141 Moffett Rd. The project will consist of all foundation preparation and installation and 20’x40’ pre-engineered metal building properly tied into existing building. This contract will consist of foundation, metal building shell and erection only. Interior work to be done by others. The new addition will be used as a Welcome Center and Chamber of Commerce.

All Bids must be on blank forms provided in the Specifications and submitted in its entirety. A cashier’s check drawn on an Alabama bank or a Bidder’s bond, payable to City of Semmes, Alabama, for an amount not less than five percent (5%) of the amount bid, but in no event more than ten thousand dollars ($10,000), shall be filed with the Bid. The Bidder’s bond shall be prepared on the form specified and signed by a bonding company authorized to do business in the State of Alabama.

A performance bond in the form and terms approved by the City in an amount not less than the contract price will be required at the signing of the Agreement. A Labor and Materials bond in the form and terms approved by the City in an amount not less than the Contract Price insuring payment for all labor and materials shall also be required at the signing of the Agreement. In addition, the Contractor must furnish to the City at the time of the signing of the Agreement a certificate of insurance coverage as provided in the Contract Documents. The City reserves the right to reject any and/or all Bids and to waive informalities and to furnish any item of material or work to change the amount of the Contract Price.

Liquidated damages for non-completion of the Work within the Contract Times will be assessed in accordance with the terms of the Contract.

Bid specifications and sketches will be emailed to contractors at no charge. Contractor will provide pre-engineered plans according to the bid documents and sketches from the City. No specifications will be issued to potential Bidders later than twenty-four (24) hours prior to the deadline indicated above for submitting bids.

Bids are invited from all qualified respondents. The City of Semmes is an Equal Opportunity Employer. All minority business enterprises (MBE) and disadvantaged business enterprises (DBE) will be taken into consideration.

No Bids will be considered unless the Bidder, whether resident or non-resident of Alabama, is properly qualified to submit a Bid for this Project in accordance with all applicable laws of the State of Alabama. This shall include evidence of holding a current license from the State Licensing Board for General Contractors, as required by Chapter 8, Title 34 of the Code of Alabama (1975). In addition, non-residents of the State, if a corporation, shall show evidence of having qualified with the Secretary of State to do business in the State of Alabama.

In evaluating Bidders, the City will consider the qualifications of the Bidders and may consider the qualifications and experience of Subcontractors, Suppliers, and other individuals or entities proposed for those portions of the Work for which the identity of Subcontractors, Suppliers, and other individuals or entities must be submitted as may be provided in the Supplementary Conditions.

The City may conduct such investigations as the City deems necessary to establish the responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, Suppliers, individuals, or entities proposed for those portions of the Work in accordance with the Contract Documents.

The City may disqualify bidders that have had prior demands placed on a bid bond, payment bond, or performance bond within the last five (5) years prior to the date of this Bid submission.

If the Contract is to be awarded, the City will award the Contract to the lowest responsive and responsible Bidder.

No Bid shall be withdrawn for a period of sixty (60) days subsequent to the opening of Bids without the consent of the City Council of the City of Semmes, Alabama.

A mandatory pre-bid conference will be held on Tuesday, May 02, 2023 at 2:00 PM at the Semmes Community Center at 10141 Moffett Road, Semmes AL 36575. All prospective Bidders must have a representative present at the pre-bid conference.

  3. The Complaint further alleges that there is currently no dispute Pending in any Court of competent jurisdiction, or otherwise to the knowledge of the Plaintiff, to test the title of either the Plaintiff or Defendants to the subject property.

ANY PARTY interested herein shall plead or answer to said Complaint on or before the 2nd day of June, 2023, or suffer a default judgment to be rendered against them.

The Plaintiff prays that the Circuit Court of Mobile County, Alabama, establish his right of possession to such land and clear up all doubts and disputes concerning the same.

Heretofore/This 6th day of January 2023, came the STATE OF ALABAMA DEPARTMENT OF HUMAN RESOURCES and filed in this Court a petition asking for the permanent custody and termination of parental rights of the parents of said child for the purpose of placing said minor for adoption.

The said Joanie Leigh Nelson Keith, mother, whose whereabouts are otherwise unknown, shall respond to the complaint no later than 30 days after the last date of publication shown herein.
