INVITATION TO BIDDERS
Notice is hereby given that sealed bids will be received by the City of Chickasaw at 224 N. Craft Highway, Chickasaw, Alabama 36671, until Tuesday, September 23, 2025 at 2:00 pm central at which time they will be publicly opened and read aloud. Envelopes containing the bids must be sealed, addressed to the City of Chickasaw, and designated as Bid for:
“GOMESA Program Stormwater Management System Remediation Project – Phase 1B”
GOMESA Grant No. G-CCPA/23/CC
The project primarily consists of the removal of aquatic vegetations and sediment from the stormwater canal and placing onto an area designated by the Owner. The work will consist of, but not limited to, removal of aquatic vegetation, removal of sediment and shaping the site with the dredge material and stockpiling the aquatic vegetation for drying and restore the area as described by the owner and could include appurtenances necessary for restoration of the existing canal.

The instructions contained in this “Notice to Bidders” shall be considered as an extension and part of the project contract documents.
No bids will be considered unless the bidder, whether resident or non-resident of Alabama, is properly licensed and qualified to submit a proposal for this construction in accordance with all applicable laws of the State of Alabama. This shall include evidence of holding a current license from the State Licensing City for General Contractors, Montgomery, Alabama, as required by Chapter 8 of Title 34, of the Code of Alabama, 1975. In addition, non-residents of the State, if a corporation, shall show evidence of having qualified with the Secretary of State to do business in the State of Alabama.

MOBILE COUNTY, ALABAMA
Sealed bids will be received by the Director of Transportation at the office of the Alabama Department of Transportation, Montgomery, Alabama until 10:00 AM on August 29, 2025 and at that time publicly opened for constructing the Cable Guiderail Installation on I-65 from MP 16.940 to MP 23.000 north of Mobile. Length 6.059 mi.
The total amount of uncompleted work under contract to a contractor must not exceed the amount of his or her qualification certificate.
The Entire Project Shall Be Completed In Sixty (60) Working Days.
A Bidding Proposal may be purchased for $5.00. Plans may be purchased for $12.00 per set. Plans and Proposals are available at the Alabama Department of Transportation, 1409 Coliseum Boulevard, Room E-108, Montgomery, AL 36110. TO THE TAXPAYERS AND CITIZENS OF THE CITY OF SEMMES, ALABAMA:
Notice is hereby given to you that a petition (the “Petition”) has been filed in the Court under the provisions of Article 17 of Chapter 6 of Title 6 of the Code of Alabama 1975, as amended, requesting the Court to validate and confirm the proposed issuance by the City of Semmes, Alabama (the “City”) of its General Obligation Warrants (Federally Taxable), Series 2025-B (the “Warrants”), under and pursuant to (i) Section 94.01 of the Alabama Constitution of 2022, as amended (also cited as Amendment No. 772 to the Constitution of Alabama of 1901, as amended), and (ii) the Ordinance 2025-64 (the “Authorizing Ordinance”) duly adopted by the governing body of the City on July 2, 2025 with respect to the Warrants and the Project Development Agreement (hereinafter defined).
The Warrants are proposed to be issued by the City in connection with an economic development project (the “Project”). The Project is proposed to be located on an approximately 0.5 acre parcel of real property and improvements presently owned by the City and located at 9070 Moffett Road in the City of Semmes (the “Real Property”). An approximately 8,000 square foot building (the “Building”) is located on the Real Property, with the Building being presently divided into two separate leasable spaces. One of the leasable spaces is presently vacant (the “Subject Premises”).
In connection with the Project, the City, the City of Semmes Cooperative District, an Alabama public corporation (the “District”), and Sucarnoochee Investments, LLC, an Alabama limited liability company (the “Company”), have entered into a Project Development Agreement dated July 15, 2025 (the “Project Development Agreement”). In order to incentivize the development of the Project, the Project Development Agreement provides for, among other things, (a) the City conveying the Project to the District; (b) the District entering into a lease contract (the “Lease Contract”) with the Tenant, whereby the District will lease the Subject Premises to the Tenant for the purpose of the Tenant locating and operating a Big Mike’s Steakhouse in the Subject Premises and the Tenant will pay rent to the District in an amount equal to five present (5%) of the Tenant’s monthly gross revenue from the Subject Premises (the “Big Mike’s Rental Payments”); (c) the District renovating and equipping the Subject Premises for the operations of the Tenant as a Big Mike’s Steakhouse (the “Series 2025-B Capital Improvements”); (d) the City paying for the cost of the Series 2025-B Capital Improvements; and (e) the District levying a fee pursuant to Chapter 99B of Title 11 of the Code of Alabama (1975) on the Tenant’s operations at the Subject Premises in an amount equal to two percent (2%) of the Tenant’s gross sales at the Subject Premises (the “Project User Fees”).
On July 2, 2025, the Board of Directors of the District (a) adopted a resolution approving the execution, delivery and performance of the Project Development Agreement and the Lease Contract (the “District Project Proceedings”, and (b) adopted a resolution imposing the Project User Fees (the “District Project User Fee Proceedings”).
The proceeds of the Warrants will be used by the City for the purposes of (a) reimbursing the City for the cost of acquiring the Real Property, (b) paying the cost of the Series 2025-B Capital Improvements, and (c) paying the cost of issuance of the Warrants. In consideration for the City’s contributions to the Project, the Project Development Agreement requires (a) the District to pay to the City on a monthly basis the Big Mike’s Rental Payments, the revenue collected from the Project User Fee and the rental revenue from the other tenant of the Building (collectively, the “Assigned Revenues”), and (b) the City to allocate to repayment of the Warrants fifty present (50%) of the monthly revenue collected by the City from the levy of the City’s current four percent (4%) sales tax on the operations of the Tenant at the Subject Premises (the “City Sales Tax Allocation”). Upon payment in full of the Warrants through the Assigned Revenues and the City Sales Tax Allocation, the Lease Contract will grant to the Tenant the option to purchase the Real Property for the sum of $100.
The Warrants shall be issued by the City in a maximum principal amount not exceeding $3,000,000 and shall be payable over a term not extending beyond October 1, 2050 from the general revenues of the City. True and correct copies of the Authorizing Ordinance, the Project Development Agreement, the Lease Contract, the District Project Proceedings and the District Project User Fee Proceedings are attached to the Petition and may be reviewed at Semmes City Hall, during the regular business hours thereof.
You, as taxpayers and citizens of the City, are required, pursuant to order of the Court entered in this cause, to show cause, if any you have, at a hearing of the Petition to be held at 9:00 a.m. on Friday, September 5, 2025, in the Courtroom of Judge Michael A.
